1. Agreement Between You and FlyinLux

Welcome to FlyinLux.com ("Website"), operated by FlyinLux LLC, a registered Wyoming travel agency. By accessing this Website or using our services, you agree to be bound by these Terms and Conditions ("Agreement"), our Privacy Policy, and any applicable laws. If you do not agree, please do not use our services.

2. Our Role

FlyinLux acts as a travel consultant and booking intermediary, providing premium flight booking services through both public and private channels, including negotiated and unpublished rates via authorized third-party suppliers. We are not an airline and do not directly provide transportation services.

3. Eligibility and Use

• Are at least 18 years old and legally able to enter contracts.
• Will use the Website and our services for legitimate reservations for yourself or someone you are authorized to represent.
• Will provide accurate, complete, and current information.
• Are not subject to sanctions that would prevent use of our services.

4. Booking Process and Payment

When you submit a flight request:

• You will receive personalized quotes from our concierge team.
• Once you approve an option, full payment is required to confirm the booking.
• We accept major credit cards and payment platforms; your card must be authorized for international payments.
• We may verify high-risk transactions and decline suspicious activity.

5. Pricing, Commissions, and Fees

• All quoted prices are inclusive of booking and concierge service charges.
• Due to the dynamic nature of flight availability, fares are subject to change until ticketed.
• Bookings involve complex sourcing and are often priced significantly below retail; these savings are our core value proposition.
• We may pay or receive referral commissions; these do not impact your price.

6. Cancellations, Changes, and Refunds

• All ticket purchases are final, non-transferable, and non-reroutable.
• Cancellation and change requests are subject to airline fare rules and FlyinLux processing fees ($250 per ticket or more).
• No-show tickets are non-refundable.
• If a flight is cancelled by the airline or unfulfilled through no fault of the client, we will endeavor to provide a refund or alternative itinerary, subject to availability.
• All refunds, if permitted, will be in the form of travel credit unless otherwise agreed.

7. No Guarantee of Availability

Discounted flight inventory is limited and not always available. If we cannot fulfill your request, we will notify you promptly.

We may offer competitive cash fares when other options are unavailable.

8. Travel Documents and Responsibilities

• You are solely responsible for obtaining and carrying valid travel documents (passport, visa, etc.).
• FlyinLux is not liable for missed flights due to inadequate documentation.

9. Limitation of Liability

• FlyinLux is not liable for losses, delays, cancellations, or changes caused by airlines, travel providers, or events beyond our control (e.g., force majeure).
• Our total liability for any claim related to a booking will not exceed the amount you paid us for that booking.
• We make no warranties regarding the performance of third-party travel providers.

10. Dispute Resolution and Governing Law

• All disputes shall be resolved by binding arbitration under the rules of the American Arbitration Association.
• You waive the right to participate in class action lawsuits.
• This Agreement is governed by the laws of the State of Wyoming.

11. Intellectual Property

All content on our Website, including the FlyinLux brand and design elements, are protected intellectual property.

You may not copy, distribute, or misuse any content without written consent.

12. Chargebacks and Fraud Prevention

Chargebacks on valid purchases are prohibited and will be disputed.

We reserve the right to cancel any booking in the event of a chargeback.

If you have concerns about charges, contact us before initiating a dispute.

13. Modifications and Updates

We reserve the right to update these Terms at any time. Continued use of our services constitutes acceptance of the latest version.
